Conditions of Use

1 Format of the contract

1.1 These terms of sale apply to all goods supplied by Come Together Ltd. T/A London Beatles Store whose registered office is at 231 Baker Street, London NW1.

1.2 No contract exists between you and Come Together Ltd. for the sale of any goods until Come Together Ltd. has received and accepted your order. Once Come Together Ltd. does so, there is a binding legal contract between us. An acknowledgement of your order will be sent to you via e-mail after your payment is taken. It is at this point that a binding legal contract is created and any contract is subject to these Terms and Conditions.

1.3 The contract is subject to your right of cancellation (see below). We hold the right to refuse any customer.

1.4 Come Together Ltd. may change these terms of sale without notice to you in relation to future sales.

1.5 These terms and conditions are subject only to UK law.

2 Description and price of the goods

2.1 The description and price of the goods you order will be as shown on the Come Together Ltd. website at the time you place your order.

2.2 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, Come Together Ltd. will inform you as soon as possible and will not charge you until your order is about to be shipped.

2.3 Every effort is made to ensure that prices shown on Come Together Ltd. website are accurate at the time you place your order. If an error is found, Come Together Ltd. will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order. If Come Together Ltd. does not receive an order confirmation within 7 days of informing you of the error, the order will be cancelled automatically

2.4 In addition to the price, you may be required to pay a delivery charge for the goods. See Shipping & Returns

3 Payment

3.1 Payment for the goods and delivery charges can be made by any method shown on Come Together Ltd. website at the time you place your order. Payment shall be due before the delivery date and time for payment shall be a fundamental term of this agreement which is commencing when the goods are shipped, breach of which shall entitle Come Together Ltd. to terminate the contract immediately.

3.2 There will be no delivery until cleared funds are received.

4 Delivery

4.1 The goods you order will be delivered to the shipping address you give when you place your order.

4.2 Orders placed before 5.00 pm on a working day will be processed that day.

4.3 If you refuse delivery because you have cancelled your contract under the Distance Selling Regulations then Come Together Ltd. shall refund you within 30 days for any sum that has been paid by you or debited from your credit card for the goods on condition of return of these goods to Come Together Ltd.. Come Together Ltd. reserves the right not to pay the return shipping costs.

4.4 Should you require the goods to be redirected to another address after the goods have been dispatched you may be required to pay an additional postage charge.

4.5 Every effort will be made to deliver the goods within the time period specified at the time of order. However, Come Together Ltd. will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, Come Together Ltd. will inform you as soon as possible.

4.6 Upon receipt of your order you will be asked to sign for the goods received in good condition. If the package does not appear to be in good condition then please refuse the delivery. If you are unable to check the contents of your delivery at the point of delivery then please sign for the parcel as UNCHECKED. This does not affect your rights as a consumer but may assist Come Together Ltd. in pursuing a future claim against our courier company,

4.7 Whilst every effort shall be made to keep any delivery date, time of delivery shall not be of the essence. The Company shall not be liable for any consequential loss incurred by the buyer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.

4.8 Delivery charges are calculated by value & or weight. There also are additional charges for handling and extra insurance. See Shipping & Returns for details.

5 Risk/Title

5.1 The goods are at your risk from the time of delivery.

5.2 Ownership of the goods shall not pass to you until Come Together Ltd. has received in full (in cash or cleared funds) all sums due to it in respect of:
5.2a the goods, and
5.2b all other sums which are or which become due to Come Together Ltd. from you on any account.

5.3 Come Together Ltd. shall be entitled to recover payment for the goods even though ownership of any of the goods has not passed from Come Together Ltd. i.e. freight insurance.

6 Your right of cancellation

6.1You have the right to cancel the contract at any time up to the end of 7 working days after you receive the goods (A working day is any day other than weekends and bank or other public holidays.)

6.2 To exercise your right of cancellation, you must give written notice to Come Together Ltd. by hand, post or via email to orders@beatlesstorelondon.co.uk, giving details of the goods ordered and (where appropriate) their delivery. Notification by phone is not sufficient.

6.3 Except in the case of faulty or misdescribed goods, if you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to Come Together Ltd. at your own cost. The goods must be returned to the address shown on the website. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. In the case of faulty or misdescribed goods we shall, after receiving notification, either collect the goods from you or ask you to return the goods yourself and possibly refund you the reasonable postage costs.

6.4 Once you have notified Come Together Ltd. that you are cancelling the contract, Come Together Ltd. will refund you within 30 days for any sum that has been paid by you or debited from your credit card for the goods on condition that Come Together Ltd. have received the returned goods.

6.5 You do not have the right to cancel the contract if the order is for consumable goods which, by their nature, cannot be returned, save where a fault is discovered which could not have been discovered otherwise than by unsealing the goods.

7 Warranty

7.1 All goods supplied by Come Together Ltd. are warranted free from defects for 7 days from the date of supply (unless otherwise stated). This warranty does not affect your statutory rights as a consumer.

7.2 This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by Come Together Ltd. or manufacturer, failure to follow Come Together Ltd. or manufacturer's instructions, or any alteration or repair carried out without Come Together Ltd. approval.

7.3 If the goods supplied to you are damaged or any item missing/incomplete on delivery, we request you notify Come Together Ltd. within 48 hours. This does not affect your statutory rights.

7.4 If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify Come Together Ltd. as soon as possible.

7.5 If a product that was faulty at the time of sale is returned to the retailer, the buyer is legally entitled to: A full Refund, If this is within a reasonable time of the sale, After a reasonable time a replacement product if possible will be offered.

7.6 It is the responsibility of the buyer to return the goods to/from Come Together Ltd. premises.

7.7 Any items which are returned under the warranty and are found to be in a good condition will be charged a testing fee of £10 or 10% of the value of the goods, whichever is the greater.

8 Limitation of Liability

8.1 Subject to 7.2 below, as you are a consumer Come Together Ltd. shall not be liable to you for any loss or damage in circumstances where:

8.1a there is no breach of a legal duty owed to you by Come Together Ltd. or by its employees or agents;

8.1b such loss or damage is not a reasonably foreseeable result of any such breach;

8.1c any increase in loss or damage resulting from breach by you of any term of this contract.

8.2 Nothing in these conditions excludes or limits the liability of Come Together Ltd. for death or personal injury caused by Come Together Ltd. negligence or fraudulent misrepresentation.

9 Returns Policy

9.1 It is the responsibility of the buyer to return goods to the Come Together Ltd. premises.

9.2 If the returned goods received by Come Together Ltd. are not in a sellable "as new" condition, then Come Together Ltd. reserves the right to make a charge for downgrading a product to a price that is less than that charged for the goods if sold as new. This charge will vary according to the condition of the returned goods. This does not affect your statutory rights.

9.3 If the buyer properly returns any of the goods in accordance with the Distance Selling Regulations within 7 working days in writing, the buyer shall nonetheless be responsible for the return cost of the goods. This does not affect your statutory rights.

9.4 Credit notes must be used within six months of the date they are issued. Any credit notes over six months old are invalid. Come Together Ltd. Reserves the right not to issue a credit at any time if required.

10 Data Protection

10.1 Come Together Ltd. knows that you care how information about you is used and shared and we appreciate your trust in us to do that carefully and sensibly.

10.2 We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input.
We reveal only the last five digits of your credit card numbers when confirming an order. Of course, we transmit the entire credit card number to the appropriate credit card company during order processing.

10.3 We maintain physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of personally identifiable customer information. Our security procedures mean that we may occasionally request proof of identity before we disclose personal information to you.

10.4 Come Together Ltd. will take all reasonable precautions to keep the details of your order and payment secure but unless Come Together Ltd. is negligent, then Come Together Ltd. will not be liable for unauthorised access to information supplied by you.

Shipping

Shipping charges are calculated automatically and added to the order total. If you are buying an expensive item, please email us at orders@beatlesstorelondon.co.uk to request a specific shipping quote.

UK
Non-urgent items (Royal Mail Standard Delivery) UK ( up to 2 kg) are delivered within 2-3 business days. Orders heavier than 2 kg (Standard Parcel) can take up to 7 business days to deliver.

Urgent items within the UK (Royal Mail Special Delivery) are delivered next day.

International
International orders are shipped by Airmail or BusinessPost, whichever is cheaper for the specific weight of your order.
